Kübra Yeşilova Released
Kübra Yeşilova from the Revolutionary Students Union, who was arrested prior to the NATO summit on the grounds of the “possibility that she might carry out a protest,” was released following her hearing at the Hatay 2nd Heavy Penal Court (ACM) on Tuesday, October 27.
Connected to the courtroom via SEGBİS (Judicial Teleconferencing System) from Diyarbakır Prison, Yeşilova was asked why she exercised her right to remain silent during her detention. Questions directed at Yeşilova included whether anyone directed her to participate in the events of the Revolutionary Students Union, Working Women, and the Struggle Union Platform; whether she knew Elif Yaş—whose photo she held during a press statement regarding sick prisoners—and why she held her photo; and why she spoke on the phone with people appearing in her HTS (Call Detail Records) logs.
In her statement, Kübra Yeşilova explained that she is the child of a working-class family, that as a female university student she is sensitive to social issues, and that she participated in various meetings, demonstration marches, and events under the exercise of her constitutional rights within the scope of freedom of expression. She stated that these institutions have no illegal activities and that she does not accept using actions where there was not even any police intervention as a basis for this crime.
While the indictment included claims that she “transferred money to individuals connected to the organization,” there was not even a prepared MASAK (Financial Crimes Investigation Board) report included, and while there were accusations attempting to link her to different organization names, no concrete evidence for these was present in the case file.
In their defense, her lawyers explained that a forced crime was being constructed through hypothetical connections, such as the claim that their client would participate in or organize an unoccurred protest prior to the NATO Summit. They argued that no crime had been committed even under Law No. 2911, and that their client had been detained for months simply for exercising her fundamental rights and freedoms.
At the end of the hearing, while the prosecution requested her release, the panel of judges decided to release Kübra Yeşilova with a ban on traveling abroad.

Kübra Yeşilova’ya Tahliye
NATO zirvesi öncesinde “eylem yapabileceği” ihtimali ile tutuklanan Devrimci Öğrenci Birliği’nden Kübra Yeşilova, 27 Ekim Salı günü Hatay 2. ACM’de görülen duruşması sonrası tahliye edildi.
Diyarbakır Cezaevi’nden SEGBİS ile mahkeme salonuna bağlanan Yeşilova’ya gözaltında olduğu süreçte neden susma hakkını kullandığı soruldu. Devrimci Öğrenci Birliği, Emekçi Kadınlar ve Mücadele Birliği Platformu’nun etkinliklerine katılmak için birisinin onu yönlendirip yönlendirmediği, hasta tutsaklarla ilgili yapılan bir basın açıklamasında fotoğrafını tuttuğu Elif Yaş’ı tanıyıp tanımadığı ve neden fotoğrafını tuttuğu, HTS kayıtlarında yer alan kişilerle neden telefonla görüştüğü, Yeşilova’ya sorulan sorular arasında.
Kübra Yeşilova da ifadesinde emekçi bir ailenin çocuğu olduğunu, üniversite öğrencisi bir kadın olarak toplumsal olaylara duyarlı olduğunu, ifade özgürlüğü kapsamında anayasal hak kullanımı kapsamında çeşitli toplantı ve gösteri yürüyüşlerine etkinliklerine katıldığını, bu kurumların herhangi bir yasa dışı faaliyeti olmadığını, herhangi bir polis müdahalesi dahi olmayan eylemlerin bu suça dayanak yapılmasını kabul etmediğini anlattı.
İddianamede “örgütle irtibatlı kişilere para transferi yaptığı” yer alırken, hasırlanmış bir MASAK raporu bile yer almıyordu ve farklı farklı örgüt isimleri ile ilişkilendirilmeye çalışan suçlamalar yer alırken, bunlar için somut bir delil ise dosyada yer almıyor.
Avukatları yaptıkları savunmasında, müvekkilin NATO Zirvesi öncesi gerçekleşmemiş bir protestoya katılacağı, organize edeceği gibi varsayımsal bağlantılarla zorlama suç oluşturulmaya çalışıldığını, 2911 sayılı kanun kapsamında dahi suçun oluşmadığını, müvekkilin temel hak ve özgürlüklerini kullanmak fiilinden aylardır tutuklu bulunduğunu anlattılar.
Duruşma sonunda savcılık tahliyesini talep ederken, mahkeme heyeti Kübra Yeşilova’nın yurtdışı çıkış yasağı ile tahliyesine karar verdi.
